UP2030 Privacy Policy

Our Privacy Policy aims to inform you regarding the processing of personal data when you use the UP2030 website. For us, your personal is of utmost importance, and we strive to meet all applicable EU data protection requirements and to ensure a high level of personal data protection. 

The UP2030 website is developed by DREVEN SRL in their capacity of UP2030 partner.

 

Data Controller

The data controller of the UP2030 website is the UP2030 Consortium (“Urban Planning and design ready for 2030”). The Partners of the UP2030 Consortium are acting as joint data controllers since they are determining the purposes and the means of processing. 

 

How do we collect information and what kind of information do we collect?

  • We collect your e-mail address when you subscribe to our Newsletter;
  • We may also collect your personal data (name, email and message itself) if you contact us via the contact form in our website. We will use it only to reply to your initial message, and not put you in any data base or further contact you.

In both cases, you must provide your explicit and informed consent which is the legal basis on which we process your personal data, in accordance with the General Data Protection Regulation.

Your consent is voluntary but necessary to receive our Newsletter and to contact us via the contact form. 

You may withdraw your consent at any time. You can withdraw your consent at any time by sending an e-mail to contact@up2030-he.eu .

 

How do we use your data?

  • If you subscribed to the Newsletter: to regularly send you the UP2030 Newsletter until you unsubscribe. You may also receive email from us with questions and information about your subscription to our Newsletter;
  • If you contact us via the contact form: to answer questions received via the UP2030 contact form.

We will use personal information only for the purpose it was originally collected for, and we will delete personal information if you withdraw your consent.

 

Are we sharing your data?

The information collected from the UP2030 website may, when necessary, be shared with the UP2030 Consortium and potentially also with the European Commission when reporting UP2030 Project results. We will only share your personal data when strictly necessary. Where possible, data will be anonymized and/or aggregated.

We do not intend to send your personal data to any third parties. In case any transfer of personal data outside the EEA would occur, we assure you that we will only do so in accordance with either Art. 45 GDPR (on the basis of an adequacy decision) or Art. 46 GDPR (appropriate safeguards in place).

 

What about cookies?

Like any other website, this website uses ‘cookies’. Cookies are small text files which are placed on your computer when you visit our website. These cookies are used to store information including visitors’ preferences, and the pages on the website that the visitor accessed or visited. The information is used to optimise the users’ experience by customising our web page content based on visitors’ browser type and/or other information. 

 

We collect: 

  • Session cookies – they are temporary cookies that are stored on your device only for the time of you stay on the website. Once you close your browser, they are automatically deleted.
  • Permanent cookies – they are stored on the website for longer than the browsing session but not longer than 12 months and handle language settings.

  • Third party cookies – they are used by third parties who operate on our website (social media or analytics partners).

  • To ask us whether we process your personal data, and if so, to obtain access to all your personal data processed by us;

  • To request restriction of the processing of your personal data, where applicable. This could for example be a temporary measure in case you contest the accuracy of your personal data and you object to the processing, pending our review of your request;
  • To receive the personal data, which you have provided on the website, in a structured, commonly used and machine-readable format and to transmit those data to another controller without hindrance from the UP2030 Consortium (data portability);
  • To withdraw your consent for the processing of personal data or for the use of the website cookies. The withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.

 

How long do we keep your data?

We process and store personal data as long as it necessary for the fulfilment of our contractual obligations under the Grant Agreement of the project, which is 5 years after the project end. When this data is no longer necessary for the above purposes, it will be regularly deleted.

 

How we keep your data?

The personal data is stored in the UP2030 database as long as you are subscribed for the UP2030 newsletter. After you unsubscribe, all personal data is immediately anonymised.

 

How can you exercise your rights as a data subject?

In order to exercise any of the rights listed above, you have to send a message to the following e-mail address contact@up2030-he.eu. Besides that, you have the right to submit a complaint to your national data protection authority, if you deem that your data is processed in an unlawful way.

General Provisions

The following Terms of Use apply to your use of the information services and resources available on the UP2030 website, developed and provided by the UP2030 Consortium.

 

Glossary 

For better understanding of the exact meaning of the Terms of Use, please find bellow the following glossary:   

    • “Admin” is the authorised person who acts on behalf of the UP2030 Consortium and its Partners and has access to the Administration panel of the UP2030 website via an Admin Account.
    • “Content” is any text, photo, any other graphical content, multimedia content, video, link, or any other material or information posted, uploaded, and accessible through the UP2030 website.

    • “Information system/System” is each particular device or combination of connected or similar devices, which or -one of which- are used in the implementation of a certain programme, which ensures automated data processing.
    • “IP address” is a unique identification number associating a device, a web page, Admin’s or a User’s resource in a way that allows their localisation in the Internet.
    • “Link” is a link (reference) designated in a particular Internet page that allows automatic forwarding to another Internet page, information resource, or object using standard protocols.
    • “Malicious actions” are actions or inactions, violating the Internet ethics or causing damages to persons connected to the Internet or associated networks, as well as sending of unsolicited communications (SPAM, JUNK MAIL), flooding, gaining access to resources by using somebody else’s rights and passwords, using system imperfections for own benefit or for gaining information (HACK), committing actions, that can be qualified as industrial espionage or sabotage, damaging or destruction of systems or information massifs (CRACK), sending of “Trojan Horses” or causing installation of viruses or unauthorised remote control systems, disturbance of the other Internet and associated networks user’s normal work, committing any actions that can be qualified as crimes or administrative offences according to the European or other applicable legislation.
    • “Partner” shall mean each of the beneficiaries within the UP2030 Consortium.
    • “Project” shall refer to any activity carried out and any result achieved within performance of Grant Agreement No. 101096405.
    • “Server” is a device or a system of connected devices, on which system software is installed to perform tasks related to storing, processing, receiving or sending information. 
    • “Services” are the information services and resources available through UP2030 website.
    • “the UP2030 website” (also referred to as “the website”, accessible via (the website address is to be inserted) is a website developed, managed, and administered by the UP2030 Consortium within the Project through which Users are provided with various information resources, subject of the present Terms of Use.
    • “User” is every natural person who uses the services and resources available through the UP2030 website. 
    • “Web Page” is a composite part of a Website.
  • “Website” is a specific place in the global Internet accessible through its unified address (URL) under HTTP or HTTPS protocol, containing files, text, programmes (software), sound, picture, image, electronic links, or other material and resources.

 

Subject

  • By developing the UP2030 website, the UP2030 Consortium provides you with Services meeting the requirements set in the current Terms of Use.  
  • There is no registration required for the use of Serivces. These Services include, but are not limited to, services relating to access to information in the form of text, video materials, images, newsletter subscription, etc., available to you as a user on the UP2030 website. 
  • Each Partner of the UP2030 Consortium as well as the Consortium as a whole, does not bear responsibility if you cannot gain access due to problems which are not in the control of the partners and the UP2030 Consortium (hardware, software issue, problems regarding Internet connection, etc.).  
  • Due to the fact that the Services and sources provided by the UP2030 Consortium are various and can constantly be modified with view to their improvement and tailoring to the aims of the Project, the number and characteristics of the Services as well as the regime of Service provision may be altered at any time by the UP2030 Consortium. 
  • The provision of the Services remains free of charge and the UP2030 Consortium will not at any time collect financial or other kind of remuneration from you. 

 

Acceptance of the Terms of Use

  • The present Terms of Use apply to the relations between the UP2030 Consortium itself and you as a User.
  • With every use of the Services on the UP2030 website including by opening a Web Page, as well as by clicking on a Link displayed on the home page or any other Web Page of the UP2030 website, you declare that you have read the present Terms of Use, agree to them and observe them.  

 

Use of UP2030 website by the User

  • You are entitled to access the UP2030 website to their full extent.
  • You are entitled to use the Content available on the website for non-commercial purposes upon the approval of the UP2030 Consortium or by providing appropriate citation and reference.
  • While using the Services provided on the UP2030 website you will :
    • not to perform Malicious Actions within the meaning of these Terms of Use;
    • not use, copy and distribute Content on the UP2030 website for any commercial purposes;
    • not impersonate another person or representative of a person who is not authorised to represent or otherwise mislead the Partners or third parties with regard to his/her identity or affiliation to a certain group of people;

 

Use of the UP2030 website by the Partner Consortium

  • DREVEN SRL as a whole, is responsible for maintaining and administrating the UP2030 website.
  • The Consortium does not have the obligation and the objective ability to control the way in which the Users use the provided Services. 
  • The Consortium does not guarantee that the information accessible on the UP2030 website, including the Content on it, is accurate, correct, and errorless.
  • The Consortium is entitled to place on each of the Web Pages of the UP2030 website Links to Websites out of the Consortium’s control. In such case, the Consortium is not liable for the content, truthfulness and conformity with the law of such Websites and resources, neither for goods or resources, which have become known to the User in the process of use of the Services, nor for the content, truthfulness and conformity with the law of the information in the opinions uploaded by them and other content.

 

Intellectual property

  • In the use of the Services, you have access to various contents and resources, which are subject to copyright of UP2030 Consortium, Partner/s or third parties indicated respectively. The content of the UP2030 website itself are licensed under Creative Commons License Attribution- Non Commercial 4.0 International (CC-BY-NC.SA 4.0) unless stated otherwise.   • The intellectual property rights on all materials and resources on the UP2030 website are subject to protection pursuant to the applicable law and are held by the UP2030 Consortium or the respective holder of the IP right that has granted the right of use to the UP2030 Consortium and may not be used in violation of the legislation in force. 

 

Liability

  • The UP2030 Consortium takes all due care that the information available on the UP2030 website is correct but does not guarantee the thoroughness of the content and does not commit to any deadlines for updating the information. The UP2030 Consortium takes due care to provide the Services for normal use, but it is not obliged to and does not guarantee that the Services provided free of charge will satisfy your expectations or that the Services will be uninterrupted and timely.
  • The use of the Services provided is entirely at your own risk and liability, and UP2030 Consortium as a whole, as well as each Partner of the Consortium individually, are not liable for any damages that might be incurred by you in the course of your use of the Services, unless such damages are caused by the Consortium itself or a Partner, intentionally or due to gross negligence.
  • The Consortium as a whole and each Partner on its own, is not liable for any damages caused on your software, hardware, devices and equipment, neither for any loss of data, arising from any materials or resources uploaded or used in any way through the medium of the Services provided.
  • The Consortium itself and every Partner individually, is not liable for non-provision of the Services due to any circumstances beyond their control – in cases of force majeure events, any problems in the global Internet and in the service provision beyond the control of the Consortium and its Partners, any problems due to your equipment, as well as in case of unauthorised access or intervention by third parties in the operation of the UP2030 website.
  • The Consortium as a whole and each Partner individually, shall not be liable for the availability, quality of the services or trustworthiness of the external information provided by third parties and indicated in the UP2030 website by means of any reference.
